1. Introduction

Welcome to the SMESS VACATION BOOKINGS Affiliate Program ("Program"). This Agreement ("Agreement") is entered into between SMESS VACATION BOOKINGS ("Company," "we," "us," or "our") and you ("Affiliate," "you," or "your"). By applying to and participating in the Program, you agree to be bound by all the terms and conditions set forth in this Agreement.

If you do not agree to these terms, please do not apply to or participate in the Program.

2. Enrollment and Eligibility

1. Application: To join the Program, you must submit a complete and accurate application through our website. We will review your application and have sole discretion to accept or reject it .
2. Eligibility: You must be at least 18 years old and legally able to enter into a binding contract. You are responsible for providing truthful and accurate information throughout your participation in the Program .

3. Affiliate Responsibilities and Obligations

1. Promotional Methods: You agree to promote SMESS VACATION BOOKINGS's services (Vacation Bookings and/or Property Management services) ethically and in a manner consistent with our brand values .

   • Prohibited Methods: You may NOT engage in any of the following :
     • Spamming, including unsolicited commercial email.
     • Bidding on our branded keywords (e.g., "SMESS VACATION BOOKINGS") in PPC campaigns without our written consent.
     • Using deceptive, misleading, or fraudulent tactics, such as "cookie stuffing" .
     • Creating websites, social media profiles, or content that mimics or impersonates SMESS VACATION BOOKINGS.
     • Promoting our services in any way that violates applicable laws or regulations.
2. Compliance: You are solely responsible for your promotional activities and must comply with all applicable laws and regulations, including consumer protection, data privacy (e.g., GDPR), and advertising laws .

4. Commission Structure and Payment

1. Earning Commissions: You will earn a commission based on Qualifying Actions generated by users who click on your unique affiliate link.
   • Qualifying Actions: This means a user clicks your affiliate link and subsequently makes a purchase for a Vacation Booking or completes a form submission for our "Manage my Property" service. 7. Termination

2. Immediate Termination: We may terminate this Agreement immediately if you breach any term of this Agreement, engage in any fraudulent activity, or if your actions are deemed harmful to our brand or reputation .
3. Effect of Termination: Upon termination, you must immediately remove all links to our website and cease using all Promotional Content and our brand name. Final commission payments may be withheld for a period of up to 90 days to account for potential refunds, chargebacks, or disputes ].

8. Limitation of Liability & Indemnification

1. Disclaimer of Warranties: Our services and the Program are provided "as is," and we disclaim all warranties, express or implied .
2. Limitation of Liability: To the maximum extent permitted by law, we will not be liable for any indirect, special, consequential, or punitive damages arising from your participation in the Program.
